Website owner, the offering, and binding of Terms

This website is owned and operated by Urban Bajrič s.p.., Ulica Pod gozdom 19, 4264 Bohinjska Bistrica, VAT ID: SI82286248. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors overview of our company and production process, online store and more. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

Availability of information

Urban Bajrič s.p. undertakes to provide the buyer with the following information before it is bound by the contract or offer:

  1. information about Urban Bajrič s.p. (name and registered office, registration number),

  2. contact details that enable the customer to communicate quickly and efficiently (e-mail, telephone);

  3. essential characteristics of the articles;

  4. availability of items (each item offered on the website should be available within a reasonable time);

  5. conditions of delivery of items (method, place and deadline of delivery);

  6. prices, which must be clearly and unambiguously set. It must be shown whether they already include taxes, transport costs and other costs;

  7. method of payment and delivery or fulfillment;

  8. the deadline within which it is possible to withdraw from the contract and the conditions for withdrawal (description of the right of withdrawal in accordance with Article 43c ZVPot; in cases where the buyer does not have the right of withdrawal in accordance with Article 43c ZVPot, it is explicitly informed);

  9. clarification of the complaint procedure, including all details of the contact person or customer service.

 

Who can use our website; what are the requirements to create an account

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal drinking age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Key commercial Terms offered to customers

When buying an item, you agree that:

  1. you are responsible for reading the full item listing before making a commitment to buy it;

  2. you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process;

  3. prices listed when placing an order are valid for that specific order;

 

The prices we charge for using our services / for our products are listed on the website and include VAT and packing costs. Shipping costs are not included in the price of products and are calculated before finalizing the order. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. The valid price is the one published on the day of the order.

Ordering goods

When purchasing alcoholic beverages, you agree that you are of legal drinking age in the country, where goods are shipped to you.

The customer is responsible for the information provided in the process of executing the order. The provider is not responsible for any errors in delivery due to the wrong address.

By clicking on the "confirm order" icon, the buyer declares that he fully understands and agrees with the GTC, that he has the appropriate legal capacity to conclude a sales contract (or that it has not been limited or revoked) and that he is of legal age. By clicking on "confirm order", the order is forwarded to the provider's information system.

The sales contract between Urban Bajrič s.p. and the customer is concluded in the Urban Bajrič s.p. online store at the moment when Urban Bajrič s.p. sends the customer the first electronic message about the status of his order. From this point on, all prices and other conditions are fixed and apply to both Urban Bajrič s.p. and the buyer. The buyer is a person with the data as stated when placing the order. It is not possible to change customer data later.

Possible payment methods:

  1. Pay by cash at pickup / delivery

  2. Credit / Debit card ( VISA, MasterCard, Maestro, American Express, Discover),

    1. Payer must be the same person / company as card owner

We use 2Checkout payment gateway as an appropriate technological and organizational service to protect the transfer and storage of personal data and payments. You can find more about their service here.

Goods delivery

Our items are shipped trough Pošta Slovenije delivery service. Normally we ship the goods the next day from receiving the order, but we reserve the right to delay the shipment date up to 5 working days in some cases. The delivery service normally takes 1-2 working days for delivery in Slovenia and up to 15 days for delivery in Europe. Urban Bajrič s.p. reserves the right to choose another delivery service if this ensures us to fulfill the order more efficiently.

Shipping costs are calculated and added to you order before the final confirmation. You will always pay exactly what you confirm on checkout step.

Shipping to Slovenia: 3,66 € for orders up to 49,99 €, free delivery for orders above 50 €.

Shipping to Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Spain, Sweden: 14 € - 65 €, depending of the weight of products.

Shipping to Albania, Andorra, Armenia, Azerbaijan, Belarus, Bosnia & Herzegovina, Iceland, Republic of Kosovo, Liechtenstein, Republic of Moldova, Monaco, Montenegro, North Macedonia, Norway, Russia, San Marino, Serbia, Switzerland, Turkey, Ukraine, United Kingdom: 17 € - 65 €, depending of the weight of products.

Return and refund policy

The buyer has the right to notify the provider (via e-mail- address info@karakter-distillery.com ) within 14 days of receiving the goods, that he is withdrawing from the contract, without having to state the reason for his decision. For any undamaged product, simply return it with its included accessories and packaging along with the original receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method or otherwise in case we reach an agreement.

In addition, please note the following:

  1. Products can be returned only in the country in which they were originally purchased;

  2. Products should be returned to: Urban Bajrič s.p., Ulica Pod gozdom 19, 4264 Bohinjska Bistrica, SLOVENIA

  3. the following products are not eligible for return;

  4. Costs related to returning the product must be covered by the customer;

  5. Returned product must be sealed with our product seal if present upon shipping, undamaged and not otherwise changed. If you have received the product that is damaged, destroyed, opened, unsealed or otherwise changed upon delivery, you should reject the goods and contact the shipping company;

  6. Refunds are returned to customer as soon as possible, but not more than in 30 days from receiving the returned goods.

Complaints and disputes

Urban Bajrič s.p. complies with applicable customer protection laws. Urban Bajrič s.p. makes every effort to fulfill its duty to provide an effective grievance redress system.

Urban Bajrič s.p. is aware that an essential feature of consumer disputes is the disproportion between the economic value of the claim and the time and costs incurred in resolving the dispute, which is also a major obstacle to the buyer not initiating litigation. Therefore, Urban Bajrič s.p. strives to the best of its ability to resolve any disputes amicably.

Out-of-court settlement of consumer disputes

In accordance with the legal norms of Urban Bajrič s.p. does not recognize any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the customer in accordance with the Out-of-Court Settlement of Consumer Disputes Act.

Urban Bajrič s.p., which as a provider of goods and services enables online trade in the territory of the Republic of Slovenia, publishes an electronic link to the online consumer dispute resolution platform (SRPS) on its website.

Retention of right to change offering

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

 

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Urban Bajrič s.p. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

 

You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

Right to suspend or cancel user account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

Indemnification

You agree to indemnify and hold Urban Bajrič s.p. harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Limitation of liability
To the maximum extent permitted by applicable law, in no event Urban Bajrič s.p., be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Urban Bajrič s.p. assumes no liability or responsibility for any:

  1. errors, mistakes, or inaccuracies of content;

  2. personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service;

  3. any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please notify us at any time.

Preference of law and dispute resolution

We are obliged to establish an effective system for handling complaints. We will endeavor to deal with the complaint as soon as possible and inform the buyer.
We will also work to resolve any disputes amicably.

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Slovenian Republic, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Radovljica, Slovenia.
